RECRUITMENT, INC. TERMS OF SERVICE
Please read this Customer Agreement carefully before signing up to use any of Recruitment, Inc.'s Services or Products. By using Recruitment, Inc.'s services, you agree to these Terms and Conditions. Recruitment, Inc. may revise these terms at any time and will notify you of any changes by emailing you the change and posting the modified terms on the website.
RECRUITMENT, INC.'S CANDIDATES AND JOB SEEKERS
Signing up is accomplished by registering online at our InterviewStudio.com website. It is your responsibility to keep your account information current in order to maintain up to date information regarding your profile. You may update your information at any time by going online and using your online ID and Password to edit your account. It is your responsibility to keep your Online ID and password confidential. If you forget your Online ID or Password, you may contact Recruitment, Inc. by email or phone and answer a privacy protected question of your choosing in order for us to ensure that you are the user requesting your Online ID or Password. Recruitment, Inc. only updates your information upon you providing it with updated information.
Control. Your InterviewStudio Showcase is private, unless you choose to include it in the InterviewStudio subscriber database. In that case, it is only viewable by subscribing Employers and Recruiters and those with whom they share your Showcase. You may send your Showcase link to any recruiter or employer you wish, and track this activity and correspondence on your personal dashboard on our website.
Membership Services and Fees. Recruitment, Inc. charges Job Seekers a fee for creating and storing their Showcase on its website. In this Showcase, a Job Seeker may include his/her resume, a brief profile, the results of the assessment test offered, endorsements, links to other relevant and appropriate documents, and a video interview. Recruitment, Inc. reserves the right to remove any document, link, or video that Recruitment, Inc. in its sole discretion deems to be offensive such as, but not limited to, the use of profanity, racism, defamatory statement, or any video containing copyrighted material(s).
Updating your Showcase. You are responsible for updating your Showcase with any new information. You will be able to continuously update the following assets of your Showcase at any time for no charge: resume, endorsements, profile information, additional or edited documents and links. You will be able to create and store as many ShowcaseS as you wish with different combinations of assets (video interview, resume, profile information, additional documents and links, assessment test results, and endorsements) for the then current Showcase Building fee per Showcase. You are responsible for reviewing all of the information that is maintained in your account. Recruitment, Inc. does not review the information to make sure it is correct and is not liable for any errors in any information that you provided. You agree that you will not post any false information in your resume and you agree to indemnify Recruitment, Inc. from any lawsuit filed against it by an Employer that hired you and later discovered that you posted false information in your Showcase.
SERVICE TERM Your InterviewStudio Showcase will remain on our site for 2 years or until you notify us to remove it, whichever occurs sooner. You may also login to your account and make your Showcase "unsearchable" so that it no longer displays in the search results of Employers and Recruiters. You agree that should you terminate your account, online access to your InterviewStudio Showcase and your account and records ceases as of the date of termination. After 30 days from the date of termination Recruitment, Inc. shall delete your account from the server. You agree that Recruitment, Inc. is under no obligation to keep your Showcase subsequent to termination. Furthermore, you release Recruitment, Inc. from any and all responsibility and/or liability due to the accessibility and use, or lack thereof, of your account and Showcase subsequent to termination.
Disclaimer of Warranties. The information on this site is intended for general information purposes only to potential employers and recruiters and does not guarantee that you will be hired for a job or be awarded an interview. All information in your Showcase is provided to Recruitment, Inc. by you. Recruitment, Inc. does not inspect your Showcase, which includes your video interview, resume, profile information, additional documents and links, assessment test results, and endorsements, for completeness or accuracy. Notwithstanding any other statement on the InterviewStudio.com web site, Recruitment, Inc. makes no warranties of any kind, either express or implied, regarding and including, but not limited to, the completeness, accuracy, reliability or availability of information or material stored by Recruitment, Inc. or otherwise available through Recruitment, Inc.. The Recruitment, Inc. service and everything on the InterviewStudio.com Web site is provided to you "as is" and "as available." Recruitment, Inc. makes no representations or warranties of any kind with respect to its services, the Web site or its content and Recruitment, Inc. does not make any guarantee that you will be hired as a result of posting your Showcase on our website. Recruitment, Inc. does not warrant that its InterviewStudio.com Web site is free of viruses or other harmful components that may affect your computer. Access to information on the InterviewStudio.com web site depends upon operation of Internet and telecommunications facilities which are not owned or controlled by Recruitment, Inc. Recruitment, Inc. therefore assumes no liability for any transmission delay, service interruption, data corruption or other problem connected with accessing the InterviewStudio.com Web site.
Recruitment, Inc. disclaims all representations and warranties, including, for example warranties of merchantability, fitness for a particular purpose and non-infringement. In addition, no information, whether oral or written, obtained from you by Recruitment, Inc. or its agents or employees shall create any warranty not expressly made in these Terms & Conditions. If any applicable authority holds any portion of this section to be unenforceable, then warranties will be disclaimed to the fullest possible extent permitted by applicable law.
Email Communications. When you sign up online you must provide your email address so that you may verify your Recruitment, Inc. account and so Recruitment, Inc. may contact you by email if necessary.
Disclaimer. Recruitment, Inc. shall not be held responsible or liable for any actions taken, either wholly or in part, based on the information provided on InterviewStudio.com or for any loss, damage, expense or injury resulting from any transactions conducted with Recruitment, Inc. The information, services, and materials contained in this website or available through our other services, and without limitation, all text, graphics, and links, are provided on an "AS IS" basis. To the maximum extent permitted by law, RECRUITMENT, INC. DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EXPRESSED OR IMPLIED, WITH RESPECT TO SUCH INFORMATION, SERVICES, AND MATERIALS, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE,-- as well as representations and warranties of title, non-infringement, freedom from computer viruses, worms, and other operating problems, and implied warranties arising from course of dealing or course of performance. Recruitment, Inc. does not represent or guarantee warrant that the information accessible via our website or other services is always accurate, complete or current. RECRUITMENT, INC. SHALL NOT HAVE ANY LIABILITY OR RESPONSIBILITY TO YOU FOR ANY LOSS, DAMAGE, EXPENSE, OR INJURY YOU MAY SUSTAIN THROUGH YOUR USE OF ANY SERVICES, whether or not they were accessed via our web site or other services. Liability Limitations IN NO EVENT SHALL RECRUITMENT, INC.'S TOTAL LIABILITY TO YOU FROM ALL DAMAGES, LOSSES, AND CAUSES OF ACTION RESULTING FROM YOUR USE OF RECRUITMENT, INC.'S SERVICES, WHETHER IN CONTRACT, TORT, (INCLUDING, BUT NOT LIMITED TO NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, EXCEED THE FEES PAID BY YOU TO RECRUITMENT, INC.
Dispute Resolution. We will try to resolve any problems or issues that you may have with our services or organization. If we are unable to reach a mutually satisfactory resolution, each of us agrees that any dispute or controversy between us, or arising in any way out of the use or operation of our web site or other services, or any information, services, products, and materials contained in this site or available through our other services, shall be submitted to confidential arbitration in Seattle, Washington, except that, to the extent you have in any manner violated or threatened to violate Recruitment, Inc.'s intellectual property rights, Recruitment, Inc. may seek injunctive or other appropriate relief in any state of federal court in the state of Washington, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this agreement shall be joined to an arbitration involving any other party subject to this agreement, whether through class arbitration proceedings or otherwise.
EMPLOYERS and RECRUITERS:
As a subscribing member of InterviewStudio.com, you will have the right to create a user account for multiple users within your company, search and view Candidate ShowcaseS in the subscriber database, contact and correspond with those candidates through the system, create private job folders in which to store the online links to those Candidate Showcases, view all of your account activities on your private dashboard, and hire candidates with no additional fees. You may use the services provided on InterviewStudio.com web site by purchasing a set amount of "Showcase VIEWS" or by purchasing a monthly, quarterly, or annual subscription for viewing the candidate database of Showcases. By registering with Recruitment, Inc. on the InterviewStudio.com web site, you authorize Recruitment, Inc. to charge your credit card in the amount of any Subscription or Viewing Fee you choose to purchase. Recruitment, Inc. retains the right, in its sole discretion, to increase these fees at any time. You must pay these fees as specified in the Service Agreement you select. Fees will be charged to your credit card on the anniversary of your account activation or monthly if you choose the monthly service fee (the Billing Date), unless the account is terminated in accordance with the InterviewStudio.com termination policies. You may update your credit card information at any time through the Billing Information profile. Should your credit card be inactive or otherwise unable to process the fees due at the Billing Date, Recruitment, Inc. will notify you by e-mail. You will then have 2 business days to update your credit card information in the Billing Information profile. If at the end of 3 business days your credit card is still inactive or unable to process the fees due, Recruitment, Inc. reserves the right to remove your Employer or Recruiter Profile, your account, job folders, client folders and their contents, dashboard content, and all other information from our database and server and terminate your access to and use of the Web site and all other services, without any further notice or any liability to you or any third party.
INDEMNIFICATION OF RECRUITMENT, INC. The Employer or Recruiter agrees to abide by all Federal, State and local laws regarding employees and candidates including but not limited to The Occupational Safety and Health (OSHA) Act, The Fair Labor Standards Act (FLSA), The Longshore and Harbor Workers' Compensation Act (LHWCA), The Employee Retirement Income Security Act (ERISA), Title VIC of the Civil Rights Act of 1964, the Equal Pay Act of 1963 (EPA), the Age Discrimination in Employment act of 1967 (ADEA), Title I and Title V of the Americans with Disabilities Act of 1990 (ADA) and the Civil Rights Act of 1991. The Employer or Recruiter agrees to indemnify and hold Recruitment, Inc. harmless in the event that a Job Seeker sues the Employer or Recruiter for a violation of any Federal, State or Local employment law. The Employer or Recruiter agrees to pay all of Recruitment, Inc.'s Attorney Fees and court costs as they are incurred including any retainer fees as well as pay for any damage award obtained by any Job Seeker against Recruitment, Inc. as a result of his or her Employment relationship with the Employer, or Service relationship with the Recruiter.
TERMINATION AND REFUND POLICY. You agree that Recruitment, Inc. may terminate your membership if you fail to pay applicable fees within 30 days of the expiration of your membership. You agree that Recruitment, Inc. may terminate your membership and your account contents in the event that it is notified that your Company's employment practices are in violation of any Federal, State or Local law. You agree that Recruitment, Inc. may restrict or terminate your use of the InterviewStudio.com Web site or any other service of Recruitment, Inc. for any reason, with or without notice to you. You agree that Recruitment, Inc. may modify or discontinue InterviewStudio.com with or without notice to you. Recruitment, Inc. shall not be liable to you or any third party for any claim or cause of action arising out of such termination, restriction, modification or discontinuance. You will have 24 hours from the date of membership activation to cancel your account and receive a full refund. After this 1 day risk-free period, you may cancel your membership at any time by submitting written notice to Recruitment, Inc. either by email to support@interviewStudio.com, Inc. or mail to: Recruitment, Inc. 14150 NE 20th St. Suite F1-518, Bellevue, WA 98007. After 24 hours you shall not be entitled to a refund on any plan. There shall be no refund on any month to month plan.
